Heard learned counsel for the petitioner.
The prayer made in the present petition is to issue a direction to the Court below namely the Additional Civil Judge (Senior Division), Agra to decide the Misc. Case No. 65 of 2009 [Smt. Vijay Katara and others vs. Sri Kishan Singh (since deceased)] in execution case no. 18 of 1992 arising out of original suit no. 379 of 1986 (Shri Kishan vs. Sri Bal Kishan).

Without expressing any opinion as to the merits of claim of the petitioner, the present petition is being disposed of with the direction to the Court below namely the Additional Civil Judge (Senior Division), Agra to decide the Misc. Case No. 65 of 2009 under Order 21 Rule 97 readwith Section 151 CPC, expeditiously, preferably within a period of three months from the date of submission of certified copy of this order and simultaneously decide the execution case no. 18 of 1992 at the earliest.
