It is alleged that a vacancy on the post of Assistant Clerk has arisen in the institution, consequent upon retirement of one Brijesh Kumar Upadhyay. According to petitioner Committee of Management, it has sought permission from the Inspector for filling upon the post in accordance with Regulation 101 framed under Chapter III of the U.P. Intermediate Education Act, 1921, but a decision in that regard is yet to be taken.
Learned Standing Counsel submits that petitioner's grievance shall be examined, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to approach respondent no.3, annexing relevant details/facts in respect of existing vacancy against class III post, alongwith certified copy of this order, within a period of two weeks from today. In case such a claim is raised, the Inspector shall act strictly in terms of regulation 101 and after seeking appropriate permission from the Director concerned, he shall pass appropriate orders within a further period of three months thereafter.
