Heard the learned counsel for the applicant and the learned AGA appearing for the State.
This application has been filed under Section 482 CrPC with a prayer to expedite proceedings of Case No.569 of 2016, under Section 125 CrPC, PS Basai Mohammadpur, District Firozabad pending in the Court of Principal Judge, Family Court, Firozabad expeditiously within a specified period of time.
It is submitted by the learned counsel for the applicant that the applicant is the neglected wife of second opposite party who has approached the Court for award of maintenance. The case is pending since the year 2016 wherein evidence of the applicant has been recorded but the second opposite party is adopting dilatory tactics, inter-alia, by not coming forward to cross- examine the applicant. It is further submitted that an application for interim maintenance is pending whereon no orders have been passed.
Looking to the aforesaid facts and circumstances, it is directed that the Principal Judge, Family Court, Firozabad shall pass orders on the application for interim maintenance within four weeks of the date of receipt of a certified copy of this order and shall thereafter proceed with and decide the proceedings under Section 125 CrPC on merits as expeditiously as possible without granting any adjournments to either of the parties preferably within a period of eight months next from the date of receipt of a certified copy of this order, unless there be a stay order of a Superior Court interdicting proceedings.
With the above orders, this application is finally disposed of.
