Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Ms. Rupal Agrawal holding brief of Sri Ashish Agrawal, learned counsel for respondent-Bank.
Submission of learned counsel for the petitioner is that despite filing of original application before the D.R.T., Allahabad, the Bank is proceeding for recovery of loan as arrears of land revenue and recovery citation has been issued.
Learned Counsel for respondent-Bank has made statement that the Bank will withdraw the recovery certificate issued against the petitioner and would proceed with the original application before the D.R.T., Allahabad.
In view of the Statement of learned counsel for respondent-Bank, on instruction from the Bank, the recovery certificate issued against the petitioner (Annexure No. 1 to the writ petition) and writ of demand dated 6.3.2019 (Annexure No.2 to the writ petition) issued by Tehsildar, Tehsil Sadar, District Kanpur Nagar, are hereby quashed.
It is made clear that Tehsildar aforesaid will not demand any collection charges from the petitioner.
