ORDER:
This application is filed by respondent No.1 in C.P.No.150 of 2009 for declaring proclamation of sale, dated 18.07.2014, issued by the Debt Recovery Officer of respondent No.3 fixing the date of auction of the company’s property as 03.09.2014, as illegal.
After arguing the case, Sri Ambadipudi Satyanarayana, learned counsel for the applicant, requested for permission of the Court to withdraw the application with liberty to his client to avail appropriate remedies available in law.
The company application is accordingly dismissed as withdrawn with liberty in terms of the prayer made.
As a sequel to dismissal of the company application, Comp.A.No.1093 of 2014 shall stand disposed of as infructuous.
