Kiritsinh vs State

High Court Of Gujarat|27 April, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the family members who are sick.
From jail remarks, we find that applicant was already on furlough leave in December, 2012.
Further, along with the application, no papers are annexed to substantiate the genuineness of the grounds so as to convince the Court about serious sickness of any of the family members.
Considering the totality of the facts, discretion does not deserve to be exercised.
Hence, application is rejected. Rule discharged.
