The present civil application has been filed for condonation of delay caused in filing the First Appeal under Section 5 of the Limitation Act on the grounds stated in the application.
Heard learned counsel, Mr.Y.V. Vaghela for the applicants, learned counsel, Mr.S.M. Shukla for the respondent no.1 and learned counsel, Mr.Nirav Sanghavi for the respondent nos.2 and 3.
In view of the grounds mentioned and considering the guidelines laid down by the Hon'ble Apex Court in catena of judicial pronouncement with regard to the approach in such matters, the present civil application deserves to be allowed.
The delay is condoned. The application stands disposed of as allowed. Rule is made absolute.
