JUDGMENT / ORDER

1. The present petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure has been preferred by the petitioner - original applicant - Revisionist to quash and set aside the impugned order dated 08/10/2010 passed by learned Additional District and Sessions Judge, Gandhinagar in Criminal Revision Application No.27 of 2008 as well as order dated 28/05/2007 passed by learned Judicial Magistrate (First Class), Gandhinagar in Criminal Misc. Application No.535 of 2004, wherein the application submitted by the petitioner to increase the amount of maintenance to the tune of Rs.10,000/- per month has been rejected.
2. Mr.Punit Juneja, learned advocate appearing on behalf of the petitioner and respondent No.2- party-in- person, who is a practicing lawyer in this Court, have jointly stated at the bar that the parties have amicably settled the dispute before Mediation Center, Gujarat High Court and in pursuant to the same, the petitioner has been paid total a sum of Rs.10 Lacs towards permanent alimony/ maintenance and that a Divorce Petition to get divorce by consent has also been filed before the concerned Court. It is further submitted that whatever amount is required to be paid to the petitioner by way of permanent maintenance, is already paid to the petitioner, which is not disputed by learned advocate appearing on behalf of the petitioner. Therefore, it is requested to dispose of the present petition.
3. In view of the aforesaid settlement arrived at between the parties before Mediation Center, Gujarat High Court and the petitioner is already paid total a sum of Rs.10 Lacs towards permanent maintenance, the present petition is disposed of in terms of settlement.
With this, the present petition is disposed of. Notice is discharged.
