HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY COMPANY PETITION Nos.198 and 199 of 2013 COMMON ORDER:
These Company Petitions are filed for ordering winding up of the respondents for non-payment of the debt due to the petitioner.
At the hearing, Sri Eranki Phani Kumar, the learned counsel for the petitioner, stated that out of the sum of Rs.7,93,40,118/- due from the respondents, it has paid to the petitioner a sum of Rs.6,60,00,000/- under a Memorandum of Understanding and that the respondents have agreed to pay the balance amount of Rs.1,33,40,118/- on or before 31.10.2014.
In view of the above, the Company Petitions are closed with liberty to the petitioner to seek reopening of the same in the event the respondents fail to pay the balance amount as per the Memorandum of Understanding.
