Heard learned counsel for the petitioner and Sri Yashwant Singh, learned counsel for the respondent no.3.
The petitioner had taken a loan from the respondent no. 3 and it appears that he has defaulted in its payment, accordingly, on behalf of the Bank a notice has been served by an advocate calling upon the petitioner to deposit the entire outstanding amount with interest, failing which, appropriate proceeding for realization of amount against the property mortgaged, would be initiated.
The petitioner have impugned the above notice by means of this petition.
The aforesaid notice is simply in the nature of a warning requiring the petitioner to make the payment.
In view of the above we do not deem it necessary to exercise our discretionary jurisdiction in the matter and leaves it open to the petitioner to contest the legal proceedings which may be initiated by the Bank, pursuant to the above notice.
The writ petition misconceived and is dismissed.
