Heard Shri Sunil Kumar Dwivedi, learned counsel for the applicant, learned A.G.A. for the State and Shri Ramesh Chandra Srivastava, learned counsel for O.P. Nos.2 to 4.
Present application under Section 482, Cr.P.C. has been filed for quashing the impugned order dated 28.11.2017 passed by Additional District & Session Judge, Court No.9, Bulandshahar in S.T. No.116 of 2017 arising out of Case Crime No.71 of 2016, under Sections 498A, 304, 506, IPC and 3/4 Dowry Prohibition Act, P.S. Narsaina, District Bulandshahar, whereby the application filed by the informant, Smt. Kiran Devi (application No.36B) under Section 319, Cr.P.C. was directed to be considered after the evidence was concluded.
It reflects from the record that in case crime No.71 of 2016 charge sheet was filed against Devendra Kumar Rana, Ompal Singh Rana, Smt. Lajja, Ranveer, Km. Rekha and Km. Rinki, under Sections 498A, 304B, 506, IPC & Section 3/4 D.P. Act, P.S. Narsaina, District Bulandshahar. Subsequently after the statement of PW-1 and PW-2 was recorded, present application was filed for summoning some other persons. The magistrate deferred the hearing of the said application on the ground that the order will be passed after the evidence is concluded by the parties.
I do not find any illegality or infirmity in the order passed by the magistrate.
Present application lacks merit and is, accordingly, dismissed.
