Heard learned counsel for the petitioner and Sri Siddharth Singh, learned Additional Chief Standing Counsel for the State- respondent.
Petitioner is before this Court with a request commanding the third respondent to grant approval of fair price shop of Gram Panchayat Shahpur, Tehsil Chhata, District Mathura in favour of the petitioner on the basis of resolution dated 9.1.2014 passed in open meeting of Gram Panchayat Shahpur which was recommended by Block Development Officer, Chhata, Mathura dated 25.2.2014.
Learned counsel for the petitioner in this backdrop states that the petitioner regarding his grievance has already made a detailed representation on 28.12.2018 which is pending consideration before the Sub Divisional Magistrate, Chhata, Mathura as such request has been made for expeditious disposal of the same.
Learned Additional Chief Standing Counsel raised an objection regarding maintainability of the writ petition on the ground of delay and laches as the entire claim has been set up on the basis of resolution dated 9.1.2014 and as such, no relief can be extended at this stage by this Court.
In the facts and circumstances, the Court is not inclined to interfere in the matter on the ground of delay and laches. However, in the interest of justice, in case there exists any vacancy of the fair price shop, the Authority concerned would proceed to decide the representation of the petitioner strictly, in accordance with law expeditiously from the date of production of certified copy of the order before him.
With the aforesaid, the writ petition stands disposed of.
