Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the proceedings initiated by 3rd respondent by undated notices issued under Section 7 and 6 of the Andhra Pradesh Land Encroachment Act, 1905 and also proceedings in Rcb/349/2012, dt. 12.12.2013 thereby insisting the petitioner to vacate from his landed property of admeasuring Ac. 1.00 cents; Ac. 1.00 cents; Ac.
1.00 cents respectively covered by Survey Numbers 345/2, 345/3 and 345/4 of Miryampalli Revenue Village, Tripuranthakam Mandal, Prakasam District, as illegal, irregular, irrational, without jurisdiction, violative of provisions of Andhra Pradesh Land Encroachment Act, 1905 and offends articles 14, 21 and 300-A of Constitution of India and consequently direct the respondents not to interfere in any manner with the petitioner's possession over the said lands.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and order of the High Court dated 13.02.2014 & 14-03-2014 made herein and upon hearing the arguments of SRI NIMMAGADDA SATYANARAYANA, Advocate for the Petitioner, GP for Revenue for Respondent Nos.1 to 3 and of GP for Home for Respondent No.4, and the Court made the following.
ORDER:
At request of GP for Revenue, post after vacation .
The interim order dated 13.02.2014 shall continue till end of June, 2014.
