HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.23893 of 2014 ORDER:
The claim of the petitioner is that he purchased an extent of Ac. 2.36 cents of Sheri dry land, situated in R.S.No.33/1 of Kanasanapalli Village, Agriripalli Mandal, Krishna District, from his vendors Smt. Nimma Lakshmikanthamma, N. Rambabu and three others vide Sale Deed bearing Document No.3735 of 2012, dated 19.04.2012. Since the date of purchase of the said landed property, the petitioner is in possession and enjoyment of the same without any interruption or objection. When the petitioner intend to dispose of the said property, and with an intention to ascertain market value of the said property, the petitioner approached the Sub-Registrar, Gannavaram, Krishna District (3rd respondent), who refused to furnish the same without assigning any reasons. Hence, this writ petition.
2. Learned counsel for the petitioner submitted that when the petitioner approached the 3rd respondent to ascertain market value, the 3rd respondent refused to furnish the same. However, there is no evidence enclosed to the writ petition paper book which discloses that such a request was made to the 3rd respondent and he refused to honour the same.

In view of the above, the Writ Petition is disposed of giving liberty to the petitioner to submit a representation in writing to the Sub-Registrar, Gannavaram, Krishna District (3rd respondent), requesting him to furnish the market value of the property claimed to have been owned by the petitioner and as and when such representation is made, the 3rd respondent shall verify and furnish the market value as requested by the petitioner. If the 3rd respondent is not inclined to furnish the market value, he shall pass a reasoned order and communicate the same to the petitioner. Such exercise shall be completed within a period of two (2) weeks from the date of receipt of representation made by the petitioner. In case the 3rd respondent has no objection and as the records would disclose that the property can be alienated, he shall also receive and process the Deed of Conveyance as and when presented by the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
