(C.M. Application No. 14907 of 2014) This is an application for substituted service by publication of notice.
Submission of learned counsel for applicant is that twice notice to opposite party no.2 was sent but no one has put in appearance on his behalf and as per service report dated 23.1.2014, it reveals that service on opposite party no.2 is deemed to be sufficient but no-one has put in appearance on behalf of opposite party no.2. Learned counsel for applicant, therefore, prays that he may be allowed substituted service on opposite party no.2 by way of publication in local daily newspaper.
On due consideration, it would be in the interest of justice that the applicant be allowed substituted service on opposite party no.2 by way of publication of notice, with respect to pendency of the instant writ petition, in local daily news paper.
The applicant shall take steps in accordance with law.
Application is disposed of accordingly.
