Heard learned counsel for the applicant and learned A.G.A. for the State.
The instant anticipatory bail application has been filed on behalf of the applicant, Khurshid Ahmad, with a prayer to release him on bail in Case Crime No.0237 of 2015, under Sections- 3/5A/8 U.P. Prevention of Cow Slaughter Act, 1955 and 11 Prevention of Cruelty to Animal Act, Police Station- Bardah, District- Azamgarh, during pendency of trial.
The applicant has been implicated for committing offence under the Cow Slaughter Act. Learned counsel for the applicant has submitted that the name of the applicant does not matches with the accused in the charge-sheet, only his father's name matches with the name of co-accused, Bechu Kankali. He has submitted that his name is not Bechu Kankali but Khurshid Ahmad.
From the material collected by the Investigating Officer it does not appears that this objection was raised before the Investigating Officer nor any such finding has been recorded. The discrepancy in the name of applicant cannot be decided in this proceeding, it is for the trial court to decide the same.
No ground is made out for grant of anticipatory bail to the applicant.
This application for anticipatory bail is devoid of merit and is accordingly rejected.
