Heard learned counsel for the applicant and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to question the correctness of the condition imposed by the court below directing the applicant to deposit the amount of Rs. 50,000/- towards recall of the ex parte order dated 17.01.2017 passed under Section 125 Cr.P.C.
Considering the fact that the interim maintenance allowance @ 4,000/- per month had been awarded to the opposite party no. 2 and her daughter from the date of the application being 10.03.2016 and that liability has not been discharged till date, the condition so imposed by the court below is neither arbitrary nor unreasonable.
In view of the above, the present application lacks merit and is accordingly dismissed.
