Petitioner has preferred the present petition inter-alia with the prayer to direct the learned Principal Judge, Family Court, Azamgarh, to decide the Case No.430 of 2021 (Khurram Alam Vs. Sheeba and othrs) within stipulated period.
Sri Vikas Tripathi, Advocate filed his Vakalatnama on behalf of respondent no. 1, the same is taken on record.
It appears from perusal of the record that immediately after filing of the suit in the Family Court, petitioner has preferred the present petition.
After some arguments learned counsel for the petitioner made a prayer that he may be permitted to withdraw this petition.
This prayer has not been opposes by Shri Vikas Tripathi, learned counsel appearing on behalf of respondent no. 1.
Prayer is allowed.
Accordingly, the present petition is dismissed as withdrawn.
It is made clear that no liberty has been granted to the petitioner to file a fresh petition on the same cause of action at least for one year.
