JUDGMENT / ORDER

Rule.
Mr.Nanavati, learned APP appears and waives service for the respondent - State.
The instant application is forwarded by applicant - convict through jail seeking parole leave for 30 days on various grounds, including on the ground that he desires to challenge the judgment and order of this Court in appeal before the Hon'ble Apex Court. It transpires that the District Magistrate, Vadodara vide order dated 1.5.2012 rejected the application of the applicant - convict for parole leave on the ground that in the year 2004, when the applicant - convict was taken to SSG Hospital, Vadodara for treatment, he absconded for 1045 days. It is pertinent to note that as per the jail remarks sheet, District Magistrate, Vadodara granted parole leave to the applicant - convict on the occasion of Diwail for 15 days from 24.10.2011 to 09.11.2011. In above view of the matter, this Court is of the opinion that the reason assigned by the District Magistrate, Vadodara in rejecting the request for parole of the applicant - convict vide order dated 1.5.2012 cannot be said to be just and proper.
In above view of the matter, the District Magistrate, Vadodara is requested to reconsider the matter and pass appropriate order within 15 days from the date of communication of this order. Registry to communicate this order to concerned jail authority as well as to the District Magistrate, Vadodara forthwith. Accordingly, the application stands disposed of.
Rule is discharged.
