High Court Of Judicature at Allahabad|27 April, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 14837 of 1998 Petitioner :- Khoob Chand Respondent :- Engg. In Chief & Others Counsel for Petitioner :- G.S.D. Mishra Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs :
"(i) Issue writ, order or direction in the nature of writ of certiorari quashing the order dated 26.3.1998 passed by the respondent.
(ii) Issue a writ, order or direction in the nature of writ of mandamus directing the respondents to not deduct any single naya paise from salary of the petitioner as rent and pay the entire salary month to month when it become due.
(iii) To issue writ, order or direction in the nature of writ of mandamus directing the respondent to fix the petitioner duty at 8 hours in every day and also award the weekly rest.
(iv) Issue writ, order or direction in the nature of mandamus directing to respondent to award the over time from 19.4.1986 to till now.
(v) Issue writ, order or direction in the nature of writ of mandamus directing to respondent to post the petitioner at office where the post of chaukidar is in existence.
(vi) Issue any writ, order or direction in the nature of writ which this Hon'ble Court deem just and proper in the circumstances of the case.
(vii) Award cost."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
