Ms.C.M.Shah, learned APP waives service of rule on behalf of the respondent-State.
This application is filed by the applicant-convict through his wife Savitaben with the request that the applicant-convict may be enlarged on temporary bail on the ground of the engagement of the daughter. The party in person, present before this Court states that the engagement is fixed on 25.2.2012 but by typographical error in the papers, the date is wrongly shown as 25.1.2012.
From the jail report, it appears that after 2008 whenever the applicant was released on bail, he has surrendered to the jail authorities in time.
The cause appears to be genuine.
Considering the fact that the applicant has surrendered to the jail authority in time, it is ordered that the applicant - convict be enlarged on temporary bail from 24th February, 2012 to 4th March, 2012 on personal bond of Rs.5,000/- and one surety of the like amount and with the further direction that the applicant-convict shall surrender before the jail authority on 5th March, 2012.
Application disposed of accordingly. Rule made absolute to the aforesaid extent. Direct service is permitted.
