(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the marriage of his son scheduled on 25th April ,2012.
Pursuant to the earlier order passed by this Court, learned APP, Shri Pandya, based on the information received from Samkhiyali Police Station, Tal. Bhachau, District: Kachchh has submitted that ground mentioned in the application is genuine.
From jail remarks, we find that the whenever the applicant-convict was enlarged on temporary bail or on furlough leave, he has surrendered to the jail authority in time.
Considering the totality of the facts, it is ordered that the applicant shall be enlarged on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs.5,000/- with one surety of the like amount and with further direction that applicant shall surrender to the jail authority on expiry of the period granted by this Court.
Application allowed to the aforesaid extent. Rule made absolute. Direct service today is permitted.
