JUDGMENT / ORDER

1. Heard Ms. Kachchhi, learned advocate for the petitioner and Mr. Hasurkar, learned advocate for the respondent electricity company.
2. The petition involves issue about the dues against the erstwhile owner of the property in question. It is claimed that various other petitions are pending in the Court on the same issue and couple of matters are under consideration by the Division Bench.
3. Ms. Kachchhi, learned advocate for the petitioner has submitted that without prejudice to its rights and contentions the petitioner is ready to deposit with respondent electricity company, the demanded amount i.e. Rs.9,11,750/- (which, actually, are the dues of the erstwhile owner from whom the petitioner purchased the premises in question) subject to final result in the petition. It is also requested by the petitioner that upon such deposit the petitioner may be granted electricity supply connection.
4. Mr. Hasurkar, learned advocate for the respondent electricity company has submitted that if the said amount is deposited and other relevant documents are submitted, then the petitioner's request would be granted, subject to final outcome of the petition.
5. In view of the said submission by the learned advocate for the petitioner and respondent electricity company, below mentioned order is passed.
Rule.
Learned advocate for the petitioner has submitted that the petitioner will, without prejudice to its rights and contentions, deposit within one week from today, the amount demanded by the respondent electricity company i.e. Rs.9,11,750/- and also submit relevant document as may be required by the respondent electricity company.
The petitioner shall abide by said stipulation.
Upon such payment and submission of the relevant document, the respondent electricity company, as stipulated by the learned advocate for the respondent electricity company, electricity supply connection shall be restored / granted as per the petitioner's application / request.
The respondent shall abide by the said stipulation.
The entire arrangement shall be subject to the final result of the petition and without prejudice to the rights and contentions of the concerned parties. Direct service is permitted.
