Heard learned counsel appearing on behalf of the petitioners and learned standing counsel for the respondent nos. 1 to 4.
Upon perusal of the averments made in the writ petition and the documents appended thereto, the grievance of the petitioner appears to be that his land has been utilized by the respondents for the purpose of construction of road without either acquiring the same or paying any compensation.
Upon perusal of the writ petition, it further transpires that for the redressal of his grievances, the petitioner had already filed several representations on 24.12.2011, 03.09.2012 and 16.02.2019 (Annexure-2, 5 and 8 to the writ petition) before the respondent authorities but even the said representations have not been decided till date.
Having heard the learned counsel for the parties, we are of the view that the interest of justice shall be served, if we dispose of this writ petition with a direction to the respondent no. 2, Special Land Acquisition Officer, Bareilly to consider and decide the petitioner's grievance within a specified period.
In view of the above, without expressing any opinion on the merits of the case, we dispose of this writ petition with liberty to the petitioner to file a fresh comprehensive representation ventilating all his grievances which she has taken by her in this writ petition before the respondent no. 2, Special Land Acquisition Officer, Bareilly within a period of two weeks from today along with certified copy of this order and in case any such representation is filed by the petitioner before the respondent no. 2 within the time indicated hereinabove, he shall consider and decide the same strictly in accordance with law by a speaking and reasoned order as expeditiously as possible preferably within a period of three months from the date of filing of such representation by the petitioner before him.
