JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Ms.Shah, learned APP waives service of notice of Rule.
The present application has been preferred by the applicant - convict for temporary bail on the ground that he wants to complete the construction of his house.
It appears from the jail report that the applicant - convict has been recently released on temporary bail on the very ground from 29.12.2011 to 17.1.2012.
Under these circumstances, the discretion does not deserve to be exercised. Therefore, the present application is not granted. Rule discharged.
