Heard learned counsel for the applicant, learned AGA and perused the record.
By means of this application, the applicant who is involved in case crime no. 390 of 2017, under Sections 302, 323, 336 IPC, P.S. Dhanari, District- Sambhal is seeking enlargement on bail during the trial.
It is contended by the learned counsel for the applicant that the applicant is named in the FIR and the co-accused Ram Pal. Both of them attributed the role of giving brick blows causing lacerated injury on the upper and lower lips one abrasion over the lip and nose and one lacerated wound on the occipital region of skull. The cause of death is shock and haemorrhage due to antemortem head injury. Both the named accused persons were assaulted by the bricks over the deceased. The incident is of 24.10.2017 at 5:00 p.m. and the FIR was registered on same day at 10:40 p.m..
Under the circumstances, I do not find any good reason to grant indulgence to the applicant. Thus, the bail application stands rejected.
It is expected from the learned trial court to gear up the trial and made necessary endeavour to conclude the trial within a period of one year from the production of certified copy of this order.
It is directed to the applicant, who will furnish the certified copy of this order before the learned trial court as expeditiously as possible within a period of one month from today.
Office is directed to communicate the copy of this order for the necessary compliance.
