Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
On being pointed out that an application under Section 24 of UP Revenue Code, 2006 is pending and is seeking injunction in this case, learned counsel for the petitioner prays that he may be permitted to correct the prayer clause regarding disposal of the proceedings.
Prayer aforesaid is allowed. He may do so during course of day.
Present petition has been filed with a prayer to direct the respondent no. 2 to decide the case filed under Section 24 of the UP Revenue Code, 2006 filed on 28.7.2021.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 2 to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of four months from the date of production of a self verified copy of this order and no unnecessary adjournments shall be granted to the parties provided there is no legal impediment as well as the functioning of the court is not affected by any reason related to COVID-19 Pandemic as well as the lawyers are not abstaining from the judicial work.
It is further provided that the dates on which the lawyers are abstaining from work shall be treated to be excluded from the period within which the proceedings are directed to be completed and in case the parties appear in person, the authority concerned shall proceed to conclude the proceedings.
With the aforesaid observations/ directions, the present petition is finally disposed of.
