The present petition has been filed for a direction upon the first respondent to decide Suit No. 42 of 1999 within a stipulated period.
It appears that earlier also the petitioner had filed petition under Article 227 No. 1016 of 2017, which was disposed of by order dated 17.02.2017 by issuing a direction that the proceeding be brought to its logical conclusion and not be held up unnecessarily.
When the matter was taken up earlier, the learned Standing Counsel was required to seek instructions in the matter. It appears that thereafter the matter was not taken up and only dates were fixed.
Considering the nature of the prayer made in this petition, no useful purpose would be served by keeping the matter pending.
Accordingly, this petition is disposed off by giving liberty to the petitioner to move an expedite application before the court concerned to decide the suit expeditiously without unnecessary delay. If any such expedite application is filed before the court concerned, in absence of any legal impediment in bringing the proceeding to its logical conclusion, the court shall endeavour to bring the suit proceeding to its logical conclusion without entertaining unnecessary adjournment from the parties.
