(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Mr.Devayat Shiyala, Deputy Mamlatdar, Taluka Maliya Hatina, District Junagadh, is personally present before the Court and states that he was Returning Officer at the relevant time, who is joined as respondent No.1, and he has come with his own affidavit as well as the affidavit of Collector, District Junagadh, who is joined as District Election Officer and respondent No.4 in the petition. The affidavits produced by him are taken on record. He has further stated that in spite of series of communications and several efforts, their affidavits could not be prepared and presently learned AGP, with whom he had had all the communication, has refused to represent them on the basis that they were at the relevant time working on deputation and election duty under the State Election Commission. Learned counsel Mr R.D.Shah submitted that presently he appears only for respondent No.6 and awaits instructions as to whether he should appear for respondent Nos.1 and 4. Learned counsel Mr.D.M.Thakkar submitted that he has now received instructions to appear for respondent No.2 and he proposes to file his affidavit as early as practicable.
Therefore, hearing is adjourned o 08.08.2012.
