1.0 By way of this petition, the petitioners have prayed for a direction directing the respondents to grant the benefit of pay-scale of Rs.3050/4590 which is revised to Rs. 5200/20200+ Grade Pay 1900 with effect from the date the old pay scale of Pagis ( Rs. 2550/3200) is revised at Rs. 3050/4990 by the Ahmedabad Municipal Corporation and to declare and hold the impugned action of rejecting the representations of the petitioners by order/communication dated 09/01/2012(7/1/2012) as illegal, arbitrary, Discriminatory and violative of Articles 14 and 16 of the Constitution of India.
2.0 On the facts of the case, this Court cannot issue any direction to grant a particular pay to particular employees. At this stage, learned advocate for the petitioners states that the petitioners will approach the Industrial Tribunal by way of appropriate application. In that view of the matter, the petition stands disposed of. Notice is discharged with no order as to costs.
3.0 If an application is made and reference is made, the Industrial Tribunal will consider the same as expeditiously as possible.
