Heard learned counsel for the petitioners and the learned A.G.A. This petition under Section 482 Cr.P.C. has been moved by the petitioners to quash the order of bailable warrant dated 08.01.2010 and the summoning order dated 16.10.2009, passed by the learned Judicial Magistrate, Ist Gonda and also to quash the entire proceedings of Case No. 38 of 2009( Smt. Pooja Gupta Vs. Khaniya Lal Gupta and another) pending in the Court of Judicial Magistrate Ist Gonda.
Learned counsel for the petitioners contends that the dispute between the parties is of matrimonial in nature. It is most likelihood that the dispute will be settled between the petitioners and the complainant -opposite party no.2 through Meditation Center. Learned counsel for petitioners, therefore, requests that matter be referred to the Meditation Center.
In view of the submission of the learned counsel for the petitioners the matter is referred to the Mediation Centre. The petitioners will deposit Rs. 7,000/-(seven thousand) within 15 days from today. Out of the amount so deposited, Rs. 5,000/-(five thousand) will be paid to the opposite party no.2 and rest of the amount of Rs. 2,000/- will be paid to the Mediation Centre. The parties will appear before the Meditation Center on 22.07.2010.
Issue notice to opposite party no.2 to appear before the Meditation Center on the date fixed.
List after two months.
Till then no coercive steps will be taken by the trial court to procure the attendance of the petitioners.
