When confronted with the observation with respect to maintainability of the writ petition for the relief prayed, inasmuch as, while father of the petitioner is alive who is recorded tenure holder petitioner cannot claim compensation, counsel for the petitioner could not show any provision to assail the proposition but sought permission to withdraw the writ petition.
Sri P.K.Mishra, Advocate holding brief of Sri Pranjal Mehrotra representing respondent no. 2, has no objection to the prayer being granted.
The writ petition, accordingly, stands dismissed as not pressed.
