JUDGMENT / ORDER

The stage carriage bus of the petitioner together with the permit has been attached in execution of the decree by the respondent bank. That should not disable the petitioner from operating service since the vehicle would have been released on executing a kaichit. Further proceedings for sale of the attached property shall however be put on hold subject to the following conditions:-
i) The petitioner shall pay a sum of Rs. 1,00,000/- towards the decree debt on or before 30.06.2014. The balance amount shall be paid in six equal monthly instalments starting from 01.08.2014.
ii) The property attached shall not be sold if the petitioner complies with the conditions in time. The property attached can be sold if the petitioner commits any default of anyone of the instalments.
iii) The petitioner shall not however transfer or further encumber the property pending discharge of the debt. The O.P.(C) No. 1192 of 2014 2 petitioner shall also surrender the vehicle to the respondent bank in the event of any default committed in the repayment.
The Original Petition is disposed of.
