The petitioner has approached this Court challenging Ext.P3 prohibitory order passed by the Village Officer. The petitioner has been prohibited for using JCB for levelling land referred in Ext.P3 alleging that it is against the Kerala Land Utilisation Order. The using a JCB for levelling a land will not constitute violation of the Kerala Land Utilisation Order unless the petitioner utilise land for other purposes without obtaining any permission. Therefore, Ext.P3 is set aside. However it is made clear if any permission is required under the Land Utilisation Order for utilising the land for other purposes, without obtaining such permission the petitioner cannot utilise the land for other purposes.
Writ petition is disposed of as above.
