Heard learned counsel for the petitioner; the learned Standing Counsel for the respondent no.1; Sri Baleshwar Chaturvedi for the respondent nos. 2 and 3; and have perused the record.
The petitioner is aggrieved with electricity disconnection notice served upon him on ground of unpaid electricity dues.
The notice reveals that there is an outstanding of Rs. 50,963/- against the petitioner for consumption of electricity for seven months.
The petitioner has neither enclosed documents to demonstrate that he had deposited all the demanded bills nor has filed any document that he has applied for correction of those bills as per the provisions of U.P. Electricity Code, 2005.
Under the circumstances, we deem it appropriate to dispose off this petition with liberty to the petitioner to deposit 60% of the demanded amount within two weeks from today. Upon deposit of the demanded amount if the petitioner moves an application for restoration of the electricity connection and for correction of the demand raised, as per the procedure prescribed by the U.P. Electricity Code, 2005, after verifying the deposit made, if any, the electricity connection of the petitioner shall be restored and the application of the petitioner for correction of the demand shall be considered in accordance with law, preferably, within next six weeks, provided application, as directed above, is submitted by the petitioner within two weeks from today.
As and when final orders are passed on the application of the petitioner in respect of correction of bills, the amount deposited, if any, by the petitioner pursuant to this order, shall be adjusted against the amount due or future bills to be raised.
With the aforesaid liberty and directions, the petition is disposed off. Order Date :- 24.9.2021 Sunil Kr Tiwari
