Heard the learned counsel for the applicant and Shri M.K.Srivastava who has appeared on behalf of the opposite party.
From the affidavit of the opposite party filed today it appears that in the service book the name of the applicant does not find mention.
The opposite party also refers to a communication dated 23.10.2017 in terms of which the applicant had been called upon to furnish proof of her being the legally wedded wife.
The respondents take the position that there is a competing claim in existence also.
In view of the aforesaid they have taken a position that till an appropriate order is obtained by the applicant from either the High Court or the District Court, no disbursal of retiral benefits can be effected.
The position so taken is clearly undisputable. Since the name of the applicant is not entered in the service records nor any succession certification has been filed, the petition stands disposed of.
The notices stand discharged.
It shall be open to the applicant to initiate appropriate proceedings and approach the respondent again after complying with the formalities mentioned on their behalf.
