Heard the learned counsel for the applicants and the learned AGA for the State and perused the record.
This application has been filed by the applicants Khalid Zamal, Irfan Khan, Ishrat Jahan, Vali Ahmad Siddiki and Zabbar Khan to quash the summoning order dated 6.5.2010 (Annexure-1) and the entire proceeding of complaint case no. 1955 of 2010, (Kafeel Ahmad Vs. Zabbar and others), under sections 147, 452, 323, 504 and 506 IPC, Police Station Kotwali Katra, District Mirzabpur pending in the court of Learned Chief Judicial Magistrate, Mirzapur.
It is submitted that in the application under section 482 bearing no. 8602 of 2010 (Tamsheel Ahmad Khan and others Vs. State of U.P. and another) the matter was sent to the mediation centre vide the order dated 17.3.2010 of this Court and the aforesaid complaint case is also in between the same parties related to each others in materimonial relations, hence this matter also deserves to be sent to the mediation centre.
Looking into the facts and circumstances of the case and on the request of the learned counsel for the applicants, this case is hereby connected with 482 application no. 8602 of 2010 and the mediation centre is directed to take up this matter too along with the aforesaid matter in between the parties. The Mediation Centre shall submit its report to this Court within one month from the date of appearance of the parties before the centre. It is also submitted that 11.7.2010 is fixed by the Mediation Centre for the parties. Therefore, the parties are permitted in this case also to appear before the mediation centre on 11.7.2010.
Let this case be listed on 17.7.2010 connected with application under section 482 No. 8602 of 2010. Till the date of listing, further proceedings of the aforesaid case shall be kept in abeyance.
