JUDGMENT / ORDER

HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29501 of 2014 ORDER:
The petitioner applied for issuance of fresh passport on 26.07.2012. The application was processed and having found that the petitioner was involved in Crime No.54 of 2012, Chandrayan Gutta Police Station, Hyderabad, notice was issued to the petitioner on 14.03.2014. This writ petition is instituted contending that even though crime is registered against the petitioner, no charge sheet is filed and he is implicated in a crime totally unconcerned to him and, therefore, denial of passport on mere ground of pendency of crime is illegal.
2. Learned Assistant Solicitor General pointed out that the petitioner has not replied to the notice issued on 14.03.2014, which fact is not denied by the learned counsel for the petitioner. Even before submitting the explanation, this writ petition is instituted. The Writ Petition in the present form is not maintainable.
3. The Writ Petition is, accordingly, disposed of, giving liberty to the petitioner to file his explanation to the notice issued on 14.03.2014. As and when such an explanation is received, the authority shall consider and take a decision, as warranted by law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
