Heard learned counsel for the petitioners, learned A.G.A. and perused the record.
Learned counsel for the petitioners has submitted that during investigation the petitioners have been enlarged on bail by the order of learned Sessions Judge. After completion of investigation, the charge-sheet has been submitted and in the charge-sheet sections 325 and 452 I.P.C. have been added. He has further submitted that the Non-Bailable-Warrants have been issued against the petitioners, but, they are willing to surrender before the concerned court in connection with newly added sections and their bail application may be directed to be disposed of expeditiously.
If the petitioners, Khaki Singh and Har Dutt Singh, surrender before the concerned court within three weeks from today and move the bail application, under newly added sections, the same shall be considered and disposed of by the courts below, expeditiously, in accordance with law.
For the period of three weeks, the execution of Non-Bailable-Warrants issued against the petitioners shall remain in abeyance.
In case of default by the petitioners, this interim order shall come to an end automatically.
With these observations/directions, the petition under Section 482 Cr.P.C. stands disposed of finally.
