JUDGMENT / ORDER

Petitioners are accused in Crime No. 236/2014 of Guruvayoor Police Station registered under section 66(A) of the Information Technology Act and section 118(d) of the Kerala Police Act. A complaint was filed by the first respondent alleging that the petitioner spread derogatory and defamatory news against the business concern run by the defacto complainant. 2. Heard the learned counsel for the petitioner and the first respondent . Learned Public Prosecutor is also heard.
3. Learned Public Prosecutor submitted that the investigation is progressing and prima facie there is evidence against the accused in the case. However, the learned counsel for the petitioners and the first respondent submitted that they have settled the matter out of court and the defacto complainant has no grievance now subsisting against the accused. Considering the averments in the complaint and the nature of allegations I find that parties have lawfully adjusted the dispute. Therefore, no benefit will be derived by any of the parties in prosecuting the case further. Hence, the F I R in Crime No. 236/2014 of Guruvayoor Police Station and all proceedings thereunder are hereby quashed.
