JUDGMENT / ORDER

1. Petitioner is aggrieved by his disqualification in the election sought to be conducted to the fourth respondent Bank. The learned counsel for the fourth respondent submits, on instructions, that the disqualification was made since, the petitioner was a defaulter to the District Co-operative Bank, Pathanamthitta and that on the disqualification of the petitioner, the only other candidate who has filed a valid nomination is to be declared elected. It is submitted that neither the District Co-operative Bank nor the other candidate has been impleaded herein as parties.
2. Learned counsel for the petitioner has filed an impleading petition I.A. No.16455 of 2014 whereby only the other candidate has been sought to be impleaded. In any event, learned counsel for the petitioner also submits that the disqualification is on the ground of W.P.(C)No.31773 of 2014 -:2:-
the petitioner having stood as a surety for a loan availed by his wife and the petitioner was never an original borrower. This is an issue which could be verified only if the District Co-operative Bank is impleaded. Even now the Bank has not been impleaded as a party.
