The prayer made in the instant petition is for issuing direction to the court below to decide the application under Order IX Rule 13 C.P.C. registered as Misc. Case No.13 of 2016, expeditiously.
The application in question was filed by the petitioner for setting aside the ex parte decree passed in Suit No.265 of 2013.
Having regard to the facts of the case and the submissions made, the instant petition is disposed of with direction to the trial court to decide the application in question, expeditiously, preferably within a period of three months from the date of receipt of certified copy of this order.
