1. Heard learned advocate Mr.Pathan for the petitioner.
2. The Family Court, Junagadh, has awarded maintenance of Rs.03,000/- per month to the original applicant No.1-wife and Rs.01,000/- per month to minor daughter- original applicant No.2, who is four years of age, from the date of application.
3. Learned advocate Mr.Pathan states that he will deposit Rs.15,000/- (Rupees Fifteen Thousand Only) on or before 28th December, 2012 with Family Court, Junagadh. On petitioner producing receipt of said deposit, Registry shall issue Notice, returnable on 21st January, 2013. It is ordered that petitioner shall deposit further amount of Rs.10,000/- (Rupees Page 1 of 2 R/CR.RA/631/2012 ORDER Ten Thousand Only) by the returnable date with the Family Court, Junagadh.
4. On deposit of amount of Rs.15,000/-, it will be permissible for respondent No.3, who is acting through respondent No.2, to withdraw the said amount. The aforesaid deposit and withdrawal of the amount shall be without prejudice to rights and contentions of the petitioner.
5. In the facts and circumstances of the case and having regard to the fact that the petitioner has been depositing amount as aforesaid, impugned order of the Family Court, Junagadh shall remain in abeyance till further orders.
