This is a successive bail application under section 439 of the Criminal Procedure Code where on the last occasion this Court by an order dated1.3.2013 had directed the applicant to approach once again to this Court for the purpose of bail, if the trial does not progress substantially on expiry of the period of six months. Though the applicant is incarcerated from 16.2.2011 only two witnesses have been examined.
Rule returnable on 27.9.2013. Learned Additional Public Prosecutor Mr. R.C.Kodekar waives service of rule for and on behalf of the State. Learned Additional Public Prosecutor to appraise the Court of the present status of the trial and the possible time to be taken by the trial.
