JUDGMENT / ORDER

Hon'ble Rajesh Chandra,J.
Heard learned counsel for the petitioner and learned Standing Counsel.
Claim is that petitioner's construction is valid and that is after sanction of the map etc. and thus the respondents have no authority to demolish or cause any interference in petitioner's rights.
Submission is that instead the respondents have passed and order dated 14.6.2010 asking the Vice Chairman of the development authority to enquire into the matter.
In view of the aforesaid, this Court need not to go into the merits of the matter but at the same time it is for this Court to direct the Commissioner to entertain the petitioner's grievance in accordance with law.
It is made clear that this Court has not touched the merits of the matter and it will be for the Commissioner to decide the matter in issue in accordance with law.
With the aforesaid direction this writ petition stands decided. In view of the direction so given, this Court further direects that so long the matter is finally concluded at the level of the Commissioner of the Division parties will maintain the status quo in respect to the nature and possession as exists today.
