Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
Learned counsel for the petitioner submitted that in several places of affidavit filed alongwith writ petition, 'respondent No. 4' has wrongly been typed in place of 'respondent No. 3', therefore, it may be read as 'respondent No. 3'.
Present petition has been filed with the following prayer:-
"(I) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide the case no. T202113380105494 of 2021 (Keshav Kumar vs. Anita and others), under section 12-C(1) of U.P. Panchayat Raj Act, pending in the court of Up-ziladhikari/ Election Tribunal, Amroha, for recounting of the votes within the stipulated time"
Learned counsel for the petitioner submitted that a suitable direction may be issued to respondent no. 2 to decide the aforesaid election petition within stipulated period for which learned Standing Counsel has no objection.
In view of the facts and circumstances of the case, with the consent of parties, the writ petition is disposed of directing the Respondent No. 2 to decide the aforesaid election petition strictly in accordance with law expeditiously, if possible within a period of six months from the date of production of computer generated copy of this order after verifying the same from official website of Allahabad High Court, without granting any unnecessary adjournment to either of the parties and after providing opportunity of hearing to all concerned. In case, election petition is not decided within the prescribed time, reasons shall be recorded for the same.
