The petitioners are aggrieved by the order passed by the Vice Chancellor of the Veer Bahadur Singh Purvanchal University, Jaunpur (hereinafter referred to as the 'University') under Section 2(13) of the U.P. State Universities Act, 1973 (hereinafter referred to as the 'Act') recognising the Committee of Management of Nagrik Degree College, Jaunpur which is affiliated to the University.
It is the contention of Sri Gajendra Pratap Singh, learned Senior Counsel appearing for the petitioners that only a valid Committee of Management of the Society can elect the Committee of Management of the Institution but in the present case election of the Society was fraudulently held as the tentative list was not published.
Sri Anil Tiwari, learned counsel appearing for the respondent- University states that against the order passed by the Vice Chancellor of the University, a reference can be filed before the Chancellor of the University under Section 68 of the Act.
In view of a statutory alternative remedy being available to the petitioners, the Court declines to entertain this petition. The pleas regarding the recognition of the Committee of Management of the Institution raised in the present petition may, therefore, be raised before the Chancellor of the University in the reference which the petitioners may file under Section 68 of the Act.
The writ petition is dismissed subject to the observations made above.
