JUDGMENT / ORDER

Supplementary-affidavit filed on behalf of the petitioners in Court is taken on record.
Heard learned counsel for the petitioners and the learned Standing Counsel for the opposite parties, who prays for and is allowed four weeks' time to file counter-affidavit. Rejoinder-affidavit, if any, may be filed within two weeks thereafter.
List immediately after expirty of the aforesaid period.
By means of this writ petition, the petitioners have challenged the transfer order dated 16.06.2007, relating to petitioner no.1, and dated 28.06.2007, relating to petitioner no.2. It has been pointed out that pursuant to the impugned transfer orders passed about three years back the petitioners have not been relieved till date but in view of the Circular of the D.G.P. dated 03.06.2010, they are likely to be relieved soon.
There appears to be no justification or reason to enforce the transfer order after a lapse of almost three years as the transfer orders are passed to meet out the exigencies of service in pursuance of the decision taken at a particular time.
Accordingly, the operation of impugned orders of transfer dated 16.06.2007 and 28.06.2007, Annexures no.1 and 2 to the writ petition, so far as it relates to the petitioners, shall remain stayed with liberty to the opposite parties to pass fresh order to meet out the exigencies of service, if necessary.
