This is an application filed under Section 482 Cr.P.C. seeking a direction to the court below to decide case no.7098 of 2011 (State of U.P. Vs. Keshari Nath and others), arising out of case crime no.279-A of 2005, under Sections 323, 324, 504 IPC, Police Station Sector 58 Noida, District Gautam Budh Nagar, pending in the court of Additional Chief Judicial Magistrate, Gautam Budh Nagar.
The applicant is the accused. It is well settled that an accused has a fundamental right under Article 21 of the Constitution to speedy trial and this case which is a warrant trial before a Magistrate is pending since the year 2011.
Looking to the aforesaid facts, it is directed that the trial court will now proceed with the trial of the aforesaid case expeditiously and conclude the same within a period of six months next from production of certified copy of this order.
The application is, accordingly, disposed of with above direction.
