(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the marriage of sons of his sister scheduled on 15th April, 2012 and 25th April, 2012.
Pursuant to the earlier order passed by this Court, learned APP, Shri Pandya, based on the instruction which he has received from Police Sub-Inspector, Sardranagar Police Station has submitted that ground mentioned in the application is genuine.
From jail remarks, we find that whenever the applicant -convict was enlarged on temporary bail, he has surrendered to the jail authority in time.
Along with this application, brother of the present applicant has also moved temporary bail application for the same cause being Criminal Misc. Application No.4538 of 2012. The said application is being considered separately.
Considering the totality of the facts, it is ordered that present applicant be release on temporary bail from 14th April, 2012 to 20th April, 2012 on personal bond of Rs.5,000/- with one surety of the like amount and with the further direction that applicant shall surrender to the jail authority on 21st April, 2012.
Application allowed to the aforesaid extent. Rule made absolute. Direct service today is permitted.
